Survey plans for easements

An easement creates specified rights over land, commonly for access, drainage, utilities or services. The survey plan defines the spatial extent of the proposed easement, while the legal instrument describes the rights, restrictions and responsibilities associated with it.

Survey and legal coordination

The plan and legal documentation must work together. A solicitor or conveyancer normally prepares or reviews the legal terms, while engineers, councils, utility authorities or other parties may specify the required location and width. All affected landowners and relevant authorities may need to consent.

Provide the title details, development conditions, engineering design, proposed easement purpose, affected properties and any draft legal documentation. Early coordination can reduce the risk of a plan being prepared around an unclear or unapproved arrangement.

No. The survey plan defines the easement area, while the relevant legal instrument and registration process create or record the rights. Obtain legal advice for the wording and effect of the easement.

Do adjoining owners need to agree?

Consent requirements depend on the land affected, ownership, authority conditions and legal mechanism. Your solicitor, conveyancer or relevant authority should advise on the necessary consents.

Can an easement be created during subdivision?

Yes, easements are commonly created in connection with subdivision, drainage, services or access. Their location and terms should be coordinated with the subdivision design and approval conditions.
